PRELIMINARY<\/strong>
\nShort title, extent
\nand
\ncommencement.
\n1. (1) This Act may be called \u201cThe—- State\/UT
\nAgricultural Produce and Livestock Marketing
\n(Promotion & Facilitation ) Act, 2017.
\n(2) It extends to the whole of State\/ Union Territory
\n(UT).
\n(3) It shall come into force on such date as the State
\nGovernment\/ Union Territory Administration may, by
\nnotification, appoint.
\nDefinition. 2. In this Act, unless there is anything repugnant in
\nthe subject or context –
\n(1) \u201cAdministration\u201d means an administration of a UT;
\n(2) \u201cAd-hoc buyer\u201d includes a buyer to be
\nregistered under Section 79 of this Act;
\n(3) \u201cAgricultural produce\u201d includes all produce,
\nwhether processed or not, of agriculture,
\nhorticulture, apiculture , forest excluding trees
\ngrown on private land, specified in the schedule ;
\n(4) \u201cAgriculturist \u201d means a person who is engaged in
\nproduction of agricultural produce including rearing
\nof livestock by himself or by hired labour or
\n5
\notherwise, including tenant;
\n\u201cAgriculturist\u201d also includes association of
\nfarmers, by whatever name called, registered under
\nany law for the time being in force and is engaged
\nin aggregation of member farmers\u2019 produce
\nincluding livestock;
\n(Explanation: If a question arises, as to whether
\nany person is an agriculturist or not for the purpose
\nof this Act, the decision of the District Collector \/
\nDeputy Commissioner\/ District Magistrate\/ Officer
\nIn-charge of Land Revenue of the District by
\nwhatever name it may be called in which such
\nperson is engaged in production of agricultural
\nproduce and\/or rearing of livestock, shall be final.
\nFurther, the expressions of land holder and tenant
\nshall have the meaning assigned to them in the
\nrespective Land Reforms Act of the States\/ UTs).
\n(5) \u201cAssaying lab\u201d means a laboratory set up, as
\nprescribed in the Rules\/Bye-laws\/guidelines\/
\ninstructions, for testing of quality parameters as per
\nthe tradable parameters or grade-standards or any
\nother parameters notified by the competent
\nauthority;
\n(6) \u201cBoard\u201d means the State\/Union Territory
\nAgricultural Marketing Board, established by
\nrespective State Government\/ Union Territory
\nAdministration;
\n(7) \u201cBuyer\u201d means a person, who himself or itself or
\non behalf of any person or agent buys or agrees to
\nbuy agricultural produce including livestock in the
\nmarket;
\n(8) \u201cBye-laws\u201d means subject to any Rules made by
\nState Government\/ UT Administration under this
\nAct, the Market Committee may, in respect of
\nprincipal market yard and sub-market yard(s) or
\nother sub market- yard(s) under its management,
\nmake Bye-laws for the regulation of business and
\n6
\nconditions of trading therein\u201d;
\n(9) \u201cCold storage\u201d means cold storage declared as
\nmarket sub-yard under Section 12 of this Act\u201d;
\n(10) \u201cCommission agent\u201d means a person who buys
\nor sells agricultural produce including livestock on
\nbehalf of his principal, or facilitates buying and
\nselling at primary and other level of transaction, on
\ne-platform or any other mode of transaction and
\nactivities ancillary thereto , keeps it in his custody
\nand controls it during the process of its sale or
\npurchase, and collects payment thereof, if required,
\nfrom the buyer and pays it to the seller, and
\nreceives by way of remuneration a commission or
\npercentage upon the amount involved in such
\ntransaction;
\n(11) \u201cDelineated Market Area\u201d means a geographical
\narea notified under Section 5 for the purpose of
\nelection of the Members of Market Committee and
\nundertaking marketing related development therein ;
\n(12) \u201cDirector\u201d means Director of Agricultural
\nMarketing or any other officer, excepting Managing
\nDirector of State\/ UT Agricultural Marketing Board,
\nappointed by the State Government\/ UT
\nAdministration, by notification to exercise and\/or
\nperform such of the powers or functions of the
\nDirector of Agricultural Marketing under the
\nprovisions of this Act or the Rules, as may be
\nprescribed in notification;
\n(13) \u201cDirect marketing\u201d in relation to agricultural
\nproduce, means direct wholesale purchase of
\nagricultural produce from the farmers by the
\nprocessors, exporters, bulk buyers, etc outside the
\nprincipal market yard, sub-market yard, private
\nmarket yard and market sub-yard under Section 13
\nof this Act;
\n7
\n(14) \u201cElectronic trading\u201d means trading of notified
\nagricultural produce including livestock in which
\nregistration, auctioning, billing, booking,
\ncontracting, negotiating, information exchanging,
\nrecord keeping and other connected activities are
\ndone electronically on computer network\/ internet;
\n(15) \u201cElectronic trading platform\u201d means electronic
\nplatform set up either by State Government\/ UT
\nAdministration or its agencies or a person licenced
\nunder Section 54 for conducting trading in notified
\nagricultural produce including livestock through
\nelectronic media or by any means of
\ncommunication in which registration, buying and
\nselling, billing, booking, contracting and negotiating
\nare carried out online through computer network\/
\ninternet or any other such electronic device;
\n(16) Export\u201d means dispatch of agricultural produce
\nincluding livestock outside India;
\n(17) \u201cFarmer-Consumer Market Yard\u201d means market
\nyard established under Section 11 of this Act;
\n(18) \u201cFarmer-Producer Company (FPC)\u201d means a
\ncompany of farmer-producer members as defined in
\nSection IXA of the Indian Companies Act,1956,
\nincluding any amendments thereto, re-enactment
\nthereof and incorporated with the Registrar of
\nCompanies;
\n(19) \u201cGovernment\u201d means the State Government;
\n(20) \u201cGovernment\/ Administration Agency\u201d means
\nState\/ UT Agricultural Marketing Department\/
\nDirectorate, State\/ UT Agricultural Marketing Board
\n(SAMB), Agricultural Produce and Livestock Market
\nCommittee (APLMC) established or constituted
\nunder this Act;
\n(21) \u201cLicence\u201d means licence granted under the
\nprovisions of this Act;
\n8
\n(22) \u201cLicensee\u201d means a person holding a licence
\nissued under the provisions of this Act;
\n(23) \u201cLivestock\u201d means cows, buffaloes , bullocks,
\nbulls, goats and sheep, and includes poultry, fish
\nand such other animals, and products thereof,
\nspecified in the schedule ;
\n(24) \u201cManaging Director\u201d means Managing Director of
\nthe State\/ UT Agricultural Marketing Board or any
\nother Officer, excepting the Director of Agricultural
\nMarketing, appointed by the State Government\/
\nUT Administration, to exercise and\/or perform
\nsuch of the powers and functions of the Managing
\nDirector or Chief Administrator or Administrator or
\nChief Executive Officer or Secretary , or by
\nwhatever name it is called, of the State\/UT
\nAgricultural Marketing Board;
\n(25) \u201cMarket Committee\u201d means the Agricultural
\nProduce and Livestock Market Committee
\nestablished under the provisions of this Act or
\nestablished under existing regulation;
\n(26) \u201cMarketing\u201d in relation to agriculture produce
\nmeans all activities involved in the flow of
\nagricultural produce from production point
\ncommencing at the stage of harvest till the same
\nreaches the ultimate consumers viz. grading,
\nprocessing, storage, transport, channels of
\ndistribution and all other functions involved in the
\nprocess;
\n(27) \u201cMarket Sub-Yard\u201d means warehouse\/ silos\/ cold
\nstorage or other such structure or place declared to
\nbe market sub-yard or deem to be market subyard under Section 12;
\n(28) \u201cMarket Yard\u201d in relation to delineated market area
\nincludes principal market yard, sub \u2013market yard
\nand market sub-yard in such delineated market
\narea notified by the Government\/ Administration,
\nand managed & operated by the Agricultural
\n9
\nProduce and Livestock Market Committee;
\n(29) \u201cMarket Yard of National Importance\u201d means a
\nmarket yard as notified under Section 9 of this Act;
\n(30) \u201cNational Agriculture Market (NAM)\u201d means an
\nintegrated market , without prejudice to any law for
\nthe time being in force, where buying and selling of
\nnotified agricultural produce including livestock and
\nactivities incidental thereto are carried out in India
\npossessing marketing utility across time and space\u201d
\n;
\n(31) \u201cNotified Agricultural Produce and Livestock\u201d
\nmeans agricultural produce and livestock, specified
\nin the schedule of this Act;
\n(32) \u201cOver trading\u201d in relation to a trader means the
\namount exceeding the value of the agricultural
\nproduce including livestock purchased at any point
\nof time vis-\u00e0-vis to the amount of security deposited
\nwith or the bank guarantee he has furnished to the
\nMarket Committee;
\n(33) \u201cPerson\u201d includes individual, a co-operative
\nsociety, Hindu Undivided Family, a company or
\nfirm or an association or a body of individuals,
\nwhether incorporated or not;
\n(34) \u201cPetty Trader\u201d in relation to agricultural produce
\nmeans a non licensee trader under this Act who
\ncarries on purchasing or selling of notified
\nagricultural produce in the quantity not exceeding
\nof such quantity as specified in this Act and
\nnotified by the State Government\/ UT
\nAdministration as retail ;
\n(35) \u201cPrescribed\u201d means prescribed by Rules and\/or
\nBye-laws made under this Act;
\n(36) \u201cPrivate Market Yard\u201d means a market yard
\nestablished under Section 10 of this Act;
\n10
\n(37) \u201cProcessing Unit\u201d means processing unit declared
\nas market sub-yard under Section 12 of this Act\u201d;
\n(38) \u201cProcessor\u201d in relation to agriculture produce
\nmeans a person that undertakes processing of any
\nnotified agricultural produce on his own accord or
\non payment of a charge;
\n(39) \u201cRegistration\u201d means registration made under this
\nAct for the purpose as specified;
\n(40) \u201cRegulation\u201d means regulation made by the Board
\nunder Section 98 in accordance with the
\nprovisions of this Act;
\n(41) \u201cRetail Sale\u201d in relation to a notified agricultural
\nproduce means, a sale not exceeding such
\nquantity as specified in this Act and notified by the
\nState Government\/ UT Administration;
\n(42) \u201cRevolving Market Development Fund\u201d means a
\nnon-lapsable Fund maintained by Director under
\nSection 112 (1) of this Act;
\n(43) \u201cRules\u201d means rules made under this Act by the
\nState Government\/ UT Administration;
\n(44) \u201cSeller\u201d means a person who sells or agrees to
\nsell agricultural produce including livestock for
\nconsideration of price;
\n(45) \u201cSchedule\u201d means the Schedule appended to this
\nAct;
\n(46) \u201cSilo\u201d means silo declared as market sub-yard
\nunder Section 12 of this Act ;
\n(47) \u201cSpecial Commodity Market Yard\u201d means a
\nmarket yard as notified under Section 8 of this Act;
\n(48) \u201cState\u201d means a State as specified in 1st Schedule
\nof the Constitution of India;
\n(49) \u201cTrader\u201d means, a person who buys notified
\nagricultural produce including livestock either for
\n11
\nhimself or as an agent of one or more persons for
\nthe purpose of selling, processing, manufacturing or
\nfor any other purpose, as the case may be , except
\nfor the purpose of domestic consumption ;
\n(50) \u201cUT\u201d means Union Territory, as specified in 1st
\nSchedule of the Constitution of India;
\n(51) \u201cYear\u201d means the year as may be notified by the
\nState Government \/ UT Administration;
\n(52) \u201cWarehouse\u201d means warehouse declared as
\nmarket sub-yard under Section 12 of this Act\u201d.
\nCHAPTER-II
\nESTABLISHMENT OF MARKETS
\nNotification of
\nintention of
\nregulating
\nmarketing of
\nspecified
\nagricultural produce
\nand livestock.
\n3.(1) The Government\/ Administration may, by notification
\nin the official gazette, declare its intention of
\nregulating the marketing of such agricultural produce
\nand livestock, in the State\/ UT, as may be specified
\nin the notification. The notification may be brought to
\nthe notice of the interested public by publishing in
\nlocal language & English on widely circulated
\nplatforms\/ media like newspapers, websites and
\nsuch other formats:
\nProvided that no area within the limits of a
\nmunicipality shall be included for regulation under
\nthis Act except after consultation with the municipal
\nBoard or municipal council , as the case may be.
\n(2) The notification under sub-section (1) shall state that
\nany objections or suggestions which may be
\nreceived by the Government\/ Administration within
\nsuch period as shall be specified in the notification,
\nnot being less than thirty days, will be considered by
\nthe Government\/ Administration.
\n12
\n(3) Government\/ Administration may hold consultations
\nwith Local bodies, including Panchayati Raj
\nInstitutions (PRIs) and autonomous district councils
\nin North-Eastern Region, who own and operate rural
\nperiodical markets or haats or any other such
\nmarkets for marketing of agricultural produce and
\nlivestock within their jurisdictional area, to bring
\nsuch markets under the regulation of this Act, so as
\nto develop these markets to efficiently function as
\nmarketing platform nearest to the farm gate.
\nDeclaration of
\nwhole State\/UT as
\none unified market
\narea.
\n4. Subject to the notification made under Section 3 and
\nafter considering such objections and suggestions as
\nmay be received from any source before expiry of
\nsuch period ,the Government\/ Administration may,
\nby another notification, declare the whole State\/ UT
\nas one unified market area specified in the
\nnotification issued under Section 3 for the purpose of
\nregulation of marketing of all or any of the kinds of
\nagricultural produce and livestock specified in the
\nnotification issued under Section 3 under this Act.
\nExplanation: The area so declared shall be a
\nsingle unified market area for the whole State\/UT for
\nregulation of marketing of notified agricultural
\nproduce and livestock.
\nNotification of
\ndelineated market
\narea.
\n5. Subject to the provision made in Sections 3 and 4,
\nthe Government\/Administration may, by further
\nnotification, delineate geographical area for a Market
\nCommittee as a delineated market area for the
\npurpose of election of the Members of such Market
\nCommittee and undertaking developmental activities
\ntherein.
\nExplanation: The Market Committee shall not
\nregulate marketing of notified agricultural produce
\nand livestock in its delineated market area. The
\nMarket Committee will enforce regulation on
\nmarketing of notified agricultural produce and
\n13
\nlivestock within the principal market yard, sub-market
\nyard(s) and market sub-yard(s).
\nAlteration\/
\nAmalgamation of
\ndelineated market
\narea and of items
\nof agricultural
\nproduce and
\nlivestock.
\n6.(1) Subject to the procedure specified in Sections 3
\nand 5, Government\/ Administration may, at any time
\nby notification , exclude from any delineated market
\narea , any area or include therein an additional area
\nor split one delineated market area in two or more
\nsuch areas or amalgamate two or more such areas
\nin one delineated market area, or may exclude any
\nnotified agricultural produce and livestock from
\nregulation , or include any agricultural produce and
\nlivestock , hitherto not regulated, for regulation under
\nthis Act.
\n(2) After the alteration of delineated market area or the
\nitems of agricultural produce and livestock, if any,
\nunder Section 6, it shall not be necessary for the
\nDirector to make any declaration under this section
\nunless he is of the opinion that it is necessary to
\ndeclare any area, hitherto not declared, as
\ndelineated market area of any Market Committee.<\/p>\n

\n7. (1) In a State\/UT, there may be-
\n(a) principal market yard(s) managed by the
\nMarket Committee;
\n(b) sub- market yard(s) managed by the Market
\nCommittee;
\n(c) market sub-yard (s) managed by the Market
\nCommittee;
\n(d) private market yard(s) managed by a person,
\nholding a licence under Section 10 ;
\n(e) private market sub-yard(s) managed by a
\nperson ,holding a licence under Section 12 ;
\n(f) farmer-consumer market yard(s) managed by
\nthe Market Committee;
\n(g) private farmer-consumer market yard(s)
\nmanaged by a person , holding a licence
\nunder Section 11 ;
\n(h) electronic trading platforms .
\n14
\n(2) The Government\/Administration shall, as soon as
\npossible after the issue of notification under
\nSections 4 and 5, by a notification, declare any
\n\u2018place\u2019 in the delineated market area as principal
\nmarket yard or sub-market yard or market sub-yard
\nor farmer-consumer market yard, as the case may
\nbe, managed by a Market Committee, for the
\npurpose of regulation of marketing of notified
\nagricultural produce and livestock, expressly or
\nimpliedly in physical , electronic or other such mode,
\nunder this Act.
\nExplanation: In this sub-section (2) , the expression
\n\u2018place\u2019 shall include any structure, enclosure, open
\nspace locality, street including warehouse\/silos\/pack
\nhouse\/cleaning, grading & packaging and processing
\nunit vested in the Market Committee of the
\ndelineated market area.
\n(3) The Government\/ Administration may, by notification,
\ndeclare a \u2018place\u2019, licenced under Section 73, to be
\nprivate market yard, private market sub- yard, private
\nfarmer-consumer market yard, as the case may be,
\nfor marketing of notified agricultural produce and
\nlivestock, expressly or impliedly in physical,
\nelectronic or other such mode, under this Act.
\nExplanation: In this sub-section (3), the expression
\n\u2018place\u2019 shall include any structure, enclosure, open
\nspace locality, street including warehouse\/silos\/pack
\nhouse\/cleaning grading & packaging and processing
\nunit vested in the person licenced for the purpose
\nunder this Act.
\nEstablishment and
\nnotification of
\n\u201cSpecial
\nCommodity Market
\nYard\u201d.
\n8. (1) Government\/ Administration may designate any
\nexisting market yard established under Section 7
\n(2) as \u201cSpecial Commodity Market Yard\u201d or establish
\nand notify any market yard as \u201cSpecial Commodity
\nMarket Yard\u201d after consideration of such aspects
\nas throughput of particular agriculture produce and
\n15
\nlivestock and special infrastructure requirements
\ntherefor. It may be-
\n(i). fruits, vegetables & flowers markets, including
\nonion market, apple market, orange market and
\nother such market;
\n(ii). cotton market;
\n(iii) medicinal and aromatic plants market;
\n(iv).livestock market including camel market, fish
\nmarket, poultry market and other such market;
\nand
\n(v) any other such markets.
\n(2) All provisions for and in relation to the Market
\nCommittee made in the Act shall mutatis mutandis
\napply to the Market Committee established for
\n\u201cSpecial Commodity Market Yard\u201d.
\nEstablishment and
\nnotification of
\n\u201cMarket Yard of
\nNational Importance
\n(MNI)\u201d.
\n9. Government\/ Administration may designate and
\nnotify any existing market yard established under
\nSection 7 (2) as \u201cMarket Yard of National
\nImportance\u201d or establish and notify any market as
\n\u201cMarket Yard of National Importance\u201d after
\nconsideration of such aspects as total throughput,
\nvalue, upstream catchment area, down-stream
\nnumber of consumers served and special
\ninfrastructure requirements therefor:
\nProvided that the market yard handling not less
\nthan such annual tonnage or such annual value, as
\nmay be prescribed, may be considered for conferring
\nthe status as the \u201cMarket Yard of National
\nImportance\u201d.
\nProvided further that out of such annual tonnage or
\nsuch annual value, 30 per cent may arrive from not
\nless than two other States.
\nEstablishment of
\nprivate market yard.
\n10. (1) Subject to such reasonable conditions and such fee
\nas may be prescribed, the Director or the Officer
\nauthorized by him may grant a licence to a person to
\n16
\nestablish a private market yard, for trading of
\nnotified agricultural produce and livestock.
\n(2) The private market yard licensee, or its management
\ncommittee, by whatever name it is called, may
\nregister commission agents and other market
\nfunctionaries to operate in the licenced private
\nmarket yard.
\n(3) The private market yard licensee, or its management
\ncommittee, may collect user charge on notified
\nagricultural produce and livestock transacted in the
\nprivate market yard, at the rate ad valorem not
\nexceeding the rate as notified by the
\nGovernment\/Administration :
\nProvided that no user charge shall be collected
\nfrom agriculturist-seller.
\n(4) The private market yard licensee shall contribute, of
\nsuch user charge collection and registration fee, to
\nthe separate \u201cRevolving Marketing Development
\nFund\u201d maintained by the Director at the rate in
\npercentage at par with Market Committee.
\n(5) The Director will spend the money from such Fund
\nunder sub-section (4) in development of common
\nmarketing infrastructure, skill development, training,
\nresearch and pledge financing and such other
\nactivities as will aid in creating an efficient marketing
\nsystem in the State\/ UT\/ Country.
\n(6) The private market licensee shall formulate a
\nStandard Operating Procedure (SOP) for conduct
\nof business and activities ancillary thereto in the
\nlicenced private market yard.
\nEstablishment of
\nfarmer- consumer
\nmarket yard (direct
\nsale of agricultural
\n11.(1) Subject to such terms & conditions and fee, as may
\nbe prescribed, the Director or the Officer authorized
\nby him, may grant licence to a person to establish
\nfarmer-consumer market yard for marketing of
\n17
\nproduce by farmer
\nto consumer in
\nretail).
\nspecified agricultural produce in retail.
\n(2) Such farmer-consumer market yard may be
\nestablished by a person by developing infrastructure,
\nas may be prescribed, and at a place accessible to
\nboth farmer(s) and consumer(s):
\nProvided that the consumer shall not purchase
\nmore than such quantity of agriculture produce at a
\ntime in this market, as may be prescribed.
\n(3) The farmer-consumer market yard licensee may
\ncollect the user charge on the sale of agriculture
\nproduce from the seller and amount so realized
\nshall be retained by farmer-consumer market yard
\nlicensee:
\nProvided further that Government\/
\nAdministration in public interest may from time to
\ntime, by notification, put ceiling on the rate of
\ncollection of user charge.
\nDeclaring
\nwarehouse\/silos\/col
\nd storage or other
\nsuch structure or
\nplace as market
\nsub-yard.
\n12. (1) Save as otherwise provided in this Act, the
\nGovernment\/ Administration may, by notification
\ndeclare warehouse\/ silos\/ cold storage or other
\nsuch structure or place with infrastructure and
\nfacilities as prescribed, to function as market subyard.
\nExplanation: the expression \u2018place\u2019 under this
\nsub-section shall include any structure, enclosure,
\nopen space, locality, street including pack
\nhouse\/cleaning grading & processing unit etc.
\n(2) The owner of such warehouse\/ cold Storage, or
\nother such structure or \u2018place\u2019, as the case may be,
\ndesirous of declaration of such place as market subyard under sub-section (1), shall apply to the Director

\nor an Officer authorized by him, in such form and in
\nsuch manner and such fee; and also for such period
\nbut not less than three years, as may be prescribed.
\n(3) The licensee of such warehouse\/ silos\/ cold storage
\nor other such structure or place, may collect user
\ncharge on notified agricultural produce transacted
\nat the declared market sub-yard under Section 12, at
\nthe rate ad valorem not exceeding the rate as
\nnotified by the Government\/ Administration :
\nProvided that no user charge shall be collected
\nfrom agriculturist-seller.<\/p>\n

(4) A declared market sub- yard licensee shall
\ncontribute, of such user charge collection, to the
\nseparate \u201cRevolving Marketing Development Fund\u201d
\nmaintained by the Director at the rate in percentage
\nat par with Market Committee. The Fund will be
\nutilized for the purposes and in the manner mutatis
\nmutandis to Section 10 (5) of this Act.

\n13. (1) Collection\/aggregation centres in the proximity of the
\nproduction areas may be set up by a person with
\ninfrastructure, as may be prescribed, with linkages to
\nretail chain, or processing\/export unit\/premises, or
\nany other such unit\/premises, as may be prescribed,
\nin accordance with the provisions of this Act and
\nRules made thereunder for marketing of notified
\nagricultural produce.
\n(2) Notwithstanding anything contained under subsection (1), direct wholesale purchase can also be
\ncarried out outside the principal market yard, submarket yard, market sub-yard, private market yard
\nby declaring the place of such purchase, without
\nestablishment of any permanent collection\/
\naggregation centre , as may be prescribed.

\n(3) Direct marketing licensee shall have to maintain
\nrecords and all accounts relating to daily trade
\ntransactions and shall submit monthly report, as
\nmay be prescribed, to the Licensing Authority.
\n(4) The Licensing Authority can seek any type of
\nadditional information from the direct marketing
\nlicensee; and can also inspect and issue direction
\nrelating to functioning of the such wholesale
\npurchases and the activities incidental thereto.
\n(5) The direct marketing licensee shall be liable to pay
\none-fourth of the applicable market fee on wholesale
\npurchases made. The such licensee shall deposit the
\ndue amount towards \u201cRevolving Marketing
\nDevelopment Fund\u201d maintained by Director for the
\nmonth by 7th day of the next month. The Fund will be
\nutilized for the purposes and in the manner mutatis
\nmutandis to Section 10 (5) of this Act.
\n(6) Notwithstanding anything contained in the Essential
\nCommodities Act, 1955 and Control Orders issued
\nthereunder or any other law for the time being in
\nforce, the provision of stock limit shall not be
\napplicable on such direct marketing licensee
\npurchasing the agricultural produce for processing\/
\nexport to the extent of his\/ its annual capacity of
\nprocessing\/ export. However, in case any dispute
\narises between the provisions of this Act and
\nEssential Commodities Act, 1955, the latter shall
